As a follow up to yesterday's post, Andrew over at Impact and the IPKat have also questioned the basis on which the Church could bring a claim against Sony. I mentioned in my previous post that we wondered whether there could be an express restriction in any agreement between Sony (or its agents) and the Church permitting photography or filming that would place limits on the use of any images obtained in the Cathedral. If so, it is conceivable that there may be some form of contractual claim even if there is no clear IP infringement.
